A 28-year-old Saratoga Springs woman was arrested on Sept. 4 on suspicion of driving while intoxicated.

According to court records, Danielle C. Smith of Adams Street faces 3 felony counts in connection with the incident, which occurred at 2:45am near the corner of Broadway* and Spring Street.

According to court documents, at the time of the arrest Smith had a blood-alcohol content of 0.19%, well over the legal limit of .08% and .01% over the threshold for qualifying as “aggravated driving while intoxicated.”

This was the second time Smith has been charged with a DWI in less than a year. She was convicted of drunk driving on Nov. 9, 2011 in the Lake George Town Court. Because she has now been charged with another DWI less than 10 years after a previous conviction, police say the charge this time is a felony rather than a misdemeanor.

Smith was also charged with three violations, including speeding, failure to signal a turn, and failure to comply with police.

She was released without bail and is scheduled to return to city court on Sept. 21.

*The original version of this story mistakenly reported the address as South Broadway

I like this blog but it isn't South Broadway at Spring Street, it's simply Broadway. When you are at Stewarts across from the Holiday Inn you are on South Broadway. Once you cross that intersection northbound its just Broadway. Just saying.

Thanks for pointing that out Nancy. We have corrected the story.
